Over Two-Million Teslas Recalled for Risk of Potential Autopilot Misuse

Over two-million electric vehicles are recalled after Tesla filed the official paperwork following the National Highway Traffic Safety Administration’s (NHTSA) determination that Tesla’s Autopilot driver-assistance system doesn’t offer enough preventative measures for misuse. The push to prevent safety flaws stems from a long-existing NHTSA defect investigation that will reportedly remain opened in wait of Tesla implementing fixes.

Autopilot, a system that uses cameras to match the moving car’s speed to its surroundings and assists drivers with staying in their lane when the road is clearly marked, comes standard on every new Tesla.

The two-million Teslas in the recall include the 2012-23 Model S, 2016-23 Model X, 2017-23 Model 3 and 2020-23 Model Y electric vehicles equipped with any version of Autosteer, a beta feature that, when hands are on the wheel, detects lane markings, vehicles and other objects to actively help the driver steer clear.

“In certain circumstances when Autosteer is engaged, the prominence and scope of the feature’s controls may not be sufficient to prevent driver misuse of the SAE Level 2 advanced driver-assistance feature,” according to the recall report that was released on Wednesday.

The report also states that Tesla drivers could be suspended from using Autosteer if they have a bad habit of failing to “demonstrate continuous and sustained driving responsibility while the feature is engaged.”

A NHTSA spokesperson stated that Tesla’s Autopilot feature is lacking when it comes to keeping drivers engaged, which could lead to “foreseeable misuse.”

“Specifically, the investigation found that Tesla’s unique design of its Autopilot system can provide inadequate driver engagement and usage controls,” the spokesperson said.

Acting NHTSA Administrator Ann Carlson confirmed during a U.S. House hearing on Wednesday that not all Tesla drivers who have Autopilot turned on are tuned in to the road. “One of the things we determined is that drivers are not always paying attention when that system is on,” she said.

Tesla reportedly promises to release updated software to correct the issue, adding more controls and alerts to keep drivers engaged in the task of driving. The software update will be available as an over-the-air download. However, University of South Carolina law professor Bryant Walker Smith, who studies transportation issues, stated that the recall “really seems to put so much responsibility on human drivers instead of a system that facilitates such misuse,” and a software-only fix may not solve the problem entirely.

“Automated technology holds great promise for improving safety, but only when it is deployed responsibly,” the NHTSA said on Wednesday. “Today’s action is an example of improving automated systems by prioritizing safety.”

U.S. Rep. Jan Schakowsky, D-Ill., said: “It’s past time to rein in Tesla’s hazardous advanced driving systems” and praised NHTSA for taking “action to protect all road users from misuse of these systems.”
