A recent change in law has stirred massive protests by the truckers all across the country, especially in the Northern India. The protests caused fuel shortages in many parts as well. Recently, the government of India brought a new hit-and-run law under the Bhartiya Nyaya Sanhita, which has made hit-and-run cases stricter by introducing longer jail terms and higher fines.
The massive three-day protest has led to traffic chaos on the highways. Many people rushed to the fuel pumps after the strikes. People waiting at the long queues at the fuel stations feared fuel being run out.
Why are the truckers protesting?
The truckers are protesting against the Bharatiya Nyaya Sanhita (BNS) passed in the recently concluded Winter Session of Parliament, which includes severe punishment for hit-and-run cases involving motorists.
Under the BNS, which replaces the Indian Penal Code from the colonial era, drivers who cause a severe accident due to negligent driving and flee without informing the police or administration can face punishment of up to 10 years in prison and a fine of Rs 7 lakh.
The All India Motor Transport Congress (AIMTC) has asked the government to address the issues raised by drivers during the nationwide protest against stringent jail and fine conditions in the BNS for hit-and-run cases. However, the protest by the truckers can lead to a potential risk of shortage of petrol, diesel, LPG cylinders and other essentials as most of the vehicles transporting these items are on strike.
In one such incident, vehicles lined up at a petrol pump in Pahalgam, Jammu and Kashmir, with motorists complaining about the non-availability of fuel due to the protest by truckers against a provision in the new penal law regarding hit-and-run road accident cases.
The protesters have resorted to violence in some places in Maharashtra, pelting stones at passing vehicles and clashing with police. Speaking on the matter, AIMTC core committee chairperson Malkit Singh said that their primary goal is to engage in constructive dialogue with the authorities to find a fair and just resolution.
Law deferred
The strike called by the truck drivers’ association has been called off after a meeting between representatives of the association and Union home ministry officials in New Delhi on January 2. Union Home Secretary Ajay Bhalla stated that they had discussions with the representatives of All India Motor Transport Congress (AIMTC), and it was agreed that the new rule under Bharatiya Nyaya Sanhita 106/2 would not be implemented without further discussions with AIMTC representatives.
Amrit Lal Madan, the president of the truckers’ body, mentioned that Union Home Minister Amit Shah has agreed to put the new hit-and-run law, which was the cause of the truck drivers’ strike, on hold. He further reiterated that until the next meeting of AIMTC is held, no laws would be implemented, including the 10-year punishment and fine that was previously imposed.
Malkit Singh also said that the AIMTC, an umbrella body of truckers, has not issued an official call regarding the current agitation, and it was a “spontaneous and widespread protest,” resulting in roadblocks and drivers refusing to ply vehicles.
The latest reports suggest that many fuel pumps in Mumbai have shortage of fuel among the protests. Many fuel pumps are still witnessing long queues due to the fear of fuel running out.
