Merchan sentenced President-elect <strong><a href=\"https:\/\/wegotthiscovered.com\/tag\/donald-trump\/\"  rel=\"noreferrer noopener\">Donald Trump<\/a><\/strong> Friday, Jan. 10, to &#8220;unconditional discharge&#8221; for Trump&#8217;s conviction in the Stormy Daniels hush money case. While &#8220;unconditional discharge&#8221; sounds like an issue a urologist might diagnose a man Trump&#8217;s age with, it&#8217;s real legal terminology.<\/p>\n<p>In this article, we&#8217;ll explain what unconditional discharge means in a legal context, and the ignoble distinction it adds to Trump&#8217;s second term, with a refresher on the Stormy Daniels hush money verdict, and what led to Trump&#8217;s conviction in the first place.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-is-unconditional-discharge\">What is unconditional discharge?<\/h2>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\">\n<div class=\"wp-block-embed__wrapper\"> <iframe loading=\"lazy\" title=\"Trump sentenced in hush money case\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/V-h2ttTJUAo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe> <\/div><figcaption class=\"wp-element-caption\">via CNN\/YouTube<\/figcaption><\/figure>\n<p>According to <a href=\"https:\/\/casetext.com\/statute\/consolidated-laws-of-new-york\/chapter-penal\/part-2-sentences\/title-e-sentences\/article-65-sentences-of-probation-conditional-discharge-and-unconditional-discharge\/section-6520-sentence-of-unconditional-discharge\"  rel=\"noreferrer noopener\">New York state law<\/a>, &#8220;unconditional discharge&#8221; imposes no prison time, fine, or probationary period for the conviction, though the conviction still stands. The New York legal code reads, &#8220;When the court imposes a sentence of unconditional discharge, the defendant shall be released with respect to the conviction for which the sentence is imposed without imprisonment, fine or probation supervision. A sentence of unconditional discharge is for all purposes a final judgment of conviction.&#8221;<\/p>\n<p>According to <a href=\"https:\/\/www.msnbc.com\/deadline-white-house\/deadline-legal-blog\/unconditional-discharge-trump-sentencing-hush-money-rcna187044\"  rel=\"noreferrer noopener\">MSNBC<\/a> News legal reporting, Trump was convicted of an \u201cE\u201d level felony in New York, the least severe kind. Examples include lawyers who fail to pay taxes or plead guilty to official misconduct, marijuana-related convictions, and other relatively low-level crimes, all of which receive unconditional discharge sentencing.<\/p>\n<p>Judge Merchan&#8217;s decision, which <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24A666\/336904\/20250109100100239_24A666%20Peoples%20Opposition%20to%20Stay.pdf\"  rel=\"noreferrer noopener\">Manhattan District Attorney Alvin Bragg&#8217;s office<\/a> announced it didn&#8217;t &#8220;oppose,&#8221; means Trump has still been convicted, but he will essentially face no punishment for the crimes.<\/p>\n<p>Merchan likely chose unconditional discharge based on legal precedent, and to avoid legal and Constitutional arguments over whether <a href=\"https:\/\/wegotthiscovered.com\/politics\/the-supreme-court-just-became-donald-trumps-last-hope-in-postponing-his-hush-money-sentencing\/\"  rel=\"noreferrer noopener\">Trump could be convicted and sentenced<\/a> at all based on previous Justice Department rulings on presidential indictments, and recent Supreme Court rulings on presidential immunity with Trump headed back to the White House.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-was-trump-s-hush-money-case-verdict\">What was Trump\u2019s hush money case verdict?<\/h2>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: Donald Trump has been sentenced &quot;unconditional discharge,&quot; meaning his conviction of 34 felonies is now official, but he will not receive prison time.<\/p>\n<p>He will, however, be the first President in history to enter the Oval Office as a convicted felon.<\/p>\n<p>What a disgrace. <a href=\"https:\/\/t.co\/1j16mESLBg\" >pic.twitter.com\/1j16mESLBg<\/a><\/p>\n<p>&mdash; Really American <img decoding=\"async\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/15.0.3\/72x72\/1f1fa-1f1f8.png\" alt=\"\ud83c\uddfa\ud83c\uddf8\" class=\"wp-smiley\" style=\"height: 1em; max-height: 1em;\" \/> (@ReallyAmerican1) <a href=\"https:\/\/twitter.com\/ReallyAmerican1\/status\/1877740293010645042?ref_src=twsrc%5Etfw\" >January 10, 2025<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script> <\/div><figcaption class=\"wp-element-caption\">via Really American\/X<\/figcaption><\/figure>\n<p>Trump was convicted in May 2023 on 34 counts related to paying former adult film actress Stormy Daniels hush money before the 2016 election to conceal Trump and Daniels&#8217; affair years earlier, which, according to the verdict, illegally influenced the election. Trump was also found guilty in New York state of falsifying business records to cover up the money spent.<\/p>\n<p>When the verdict was announced, <a href=\"https:\/\/apnews.com\/article\/trump-trial-deliberations-jury-testimony-verdict-85558c6d08efb434d05b694364470aa0\"  rel=\"noreferrer noopener\">Trump said in court<\/a>, &#8220;This was a rigged, disgraceful trial. The real verdict is going to be Nov. 5&#8221; \u2014 election day \u2014 &#8220;by the people. They know what happened, and everyone knows what happened here.\u201d<\/p>\n<p>Trump appeared virtually from Florida in a New York court Friday to hear Merchan&#8217;s unconditional discharge decision. &#8220;Never before has this court been presented with such a unique and remarkable set of circumstances,&#8221; Merchan said, clarifying he would sentence Trump to unconditional discharge on all 34 counts related to the case.<\/p>\n<p>After the verdict was read, Trump wrote on <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/113804764963563444\"  rel=\"noreferrer noopener\">Truth Social<\/a>, &#8220;THERE IS NO CASE, THERE WAS NEVER A CASE, and this whole Scam fully deserves to be DISMISSED.
